नेपाल प्रेस युनियनको केन्द्रीय सदस्य रहेका परियार Association of Dalit Journalists Nepal (ADJON) का अध्यक्ष हुन । आम संचार तथा पत्रकारितामा एम ए गर्नु भएका परियार नेपाल प्रेस इिन्स्टच्यूट (NPI) संग्ा समेत आवद्ध छन् । अमेरिकी सरकारको निमन्त्रणामा सन २ हजार ७ मा डेढ महिने आमसंचार तथा पत्रकारिता फेलोसिप पाएका परियारले अमेरिकी आमसंचारका विभिन्न आयामवारे अमेरिकाका ७ वटा राज्यको स्थलगत संचार अवलोकन भ्रमण सम्पन्न गरेर नेपालमा व्यवसायिक पत्रकारिता गरिरहेका छन् । मानव अधिकार समावेशी र सामाजिक मामिला तथा मानव अभिरुचीलाई आफ्नो पत्रकारिताको केन्द्रविन्दू वनाएका पत्रकार परियार दलित अधिकारमुखी सवालमा कलम चलाउनु हुन्छ ।

Cultural Structure
One of the more confusing mysteries of India is her caste system. The caste system, which has existed for more than 3,000 years, was developed by the Brahmin (priest) caste in order to maintain their superiority. Eventually, the caste system became formalized into four distinct classes (Varna).
The Brahmins are the highest Varna and are the priests and arbiters of what is right and wrong in matters of religion and society. Below them are the Kshatriyas, who served traditionally as soldiers and administrators. The Vaisyas are the artisan and commercial class, while the Sudras are the farmers and the peasants. It is said that the Brahmin come from Brahma’s mouth, Kshatriyas from his arms, Vaisyas from his thighs, and Sudras from his feet.

Beneath the four main castes is a fifth group, the Scheduled Castes. The people of the Scheduled Castes are not part of the Varna system. They are the untouchables, the Dalit.

A Dalit is not considered part of human society, but instead is considered something less than human. The Dalits generally perform the most menial and degrading jobs. Caste rules hold that Dalits pollute higher caste people with their presence. If higher caste Hindus touch an untouchable or even come within a Dalit’s shadow, they must undergo rigorous series of cleansing rituals.

Approximately 250 million Indians (a full 25% of the population), are Dalit. In a country where everybody is supposed to have equal rights and opportunities, one out of four people is condemned to be untouchable.

Although the Indian Constitution guarantees fundamental rights and freedoms for all Indians, Dalit are systematically abused. Dalit are poor, deprived and socially backward. Their most basic needs of food, shelter, and safety are not fulfilled. They also cannot access decent education and employment. The systematic denial of their basic human rights results in a lack of education, food, healthcare, and economic opportunity, thereby keeping Dalit in perpetual bondage to the upper castes.

The Dalits represent one of the greatest outreach opportunities for the world Church.They are wanting to be freed from the oppressive caste system.May the Church rise to to task and through prayer and ministry bring them into the freedom that is in Christ.

BANGALORE: Political luminaries of the state congregated at a socialist forum's convention in the city on Tuesday to raise a toast to Barack Hussein Obama for transcending the racial divide and make it to the helm of the most powerful nation on the earth.
None of these politicos shed even a tear to the plight of 15 Dalit families of Lakkasandra, about 40 km from the city, who are facing social ostracisation after one of them, 24-year-old Gangamma, ended her life after she was harassed by the caste Hindus of the village.
Six months ago, another Dalit Najundappa was fined for drawing water from the same tank.
"After Gangamma's suicide, Dalits are facing an undeclared social boycott in Lakkasandra. All the Dalits here are agricultural labourers working in the fields of upper caste Vokkaligas. No one in the village or even from the neighbouring village is willing to give jobs Dalits," said Mallige S, secretary, Samanatha Mahila Vedike told mediapersons in Bangalore on Wednesday.
The Vedike, Swabhimani Dalit Shakti, Karnataka Dalit Mahila Okkutta and Navajagruthi Mahila Sangha released a fact-finding committee report on what led Gangamma to take the extreme step and resultant backlash the other Dalits of the village are facing.
The fact-finding committee has found out that Gangamma allegedly paid with her life for fetching water from a well belonging to a dominant community.

The Audacity of Hope
Hope is a tricky word. It never guarantees anything, but it makes the world go round. Hope was the only possession of the skinny lad with dark skin and a funny name, starting with B, when he arrived in New York, wondering if America had a place for him, too. During his years at Columbia, as he majored in political science, the young man learnt a few important lessons from some American greats. Emerson taught him that “consistency is a virtue of an ass”. From Abe Lincoln, he learnt that freedom is worth dying for. As he pored over history books, he became sad and angry. And he came out of the campus craving for Change — not just for himself but for his people who hadn't been free as long as he could remember. The name of this man was Bhimrao Ramji Ambedkar, and the year was 1913. Barack Obama came out of the same university with the same degree 70 years later, with the same mantra on his lips: Change.
Brown Man's Burden
The Obama victory shows us that we may be the world’s largest democracy, but America is the world’s greatest democracy. It’s not just the obvious fact of a Black man getting to the White House. It’s also the way in which he did it, by taking on the powers-that-be in his party and by refusing to run as the caricature ‘Black candidate’. Which other country has an electoral system that is so truly representative that a man can come from virtually nowhere and end up in the White House?
We are a long way from that point. Over the last two decades, Indian politics has got worse rather than better: obsessed with caste, predicated on identity, favouring regional perspective over national interest and filling its ranks with the sons and daughters of the powerful.
When Obama stood up in Chicago and declared, “If there is anybody out there who still doubts that America is a place where all things are possible…. today is your answer”, we had to agree.
And I, for one, wondered when such a day would come in India.

Vice President Parmananda Jha told a Madhesi Intellectual gathering in Biratnagar on Saturday, November 8, 2008, that the political parties must stop adopting to the principles of regionalism.
“The politics of regionalism and caste based discrimination will only take the country into further conflict”, Mr. Jha opined.
“The age-old Madhesi-Pahadi based discrimination must come to an end to avoid further conflict”, VP Jha maintained.
“Nepal is made up of Himal, Pahad and Madhesh, thus the current political leadership must shun politics of narrow thinking”
“The Pahadi population who have been living in Madhesh for long are also Madhesis and the Madhesis living in Pahad are Pahadis.”
“I did my graduation in the Great County of India…thus it is natural that I have some liking to India and I believe that Language should not become a part of politics.”
“We can use any language as a mode of communication but we must remain committed to serving the people.”
Having said that, analysts conclude that the Vice President Jha must not have raised these issues and used the language that divide the Nepalese. Whether the Nepalese live in Himal, Pahad and Madhesh, all are Nepalese first.
The bitter experiences of the past, analysts conclude, must not find place in the statements of the high flying political personalities who are supposed to be the “guardian” of the entire Nepal.

Columnist Chandrabhan Prasad points out that unlike many Indian politicians, throughout the campaign Obama never used the "identity" card. "He did not talk about his identity as a black American. He just charted out policies that will benefit all Americans, especially the poor. Since blacks make up a sizeable section of the poor, they will automatically benefit. But he hasn't appealed to blacks as a single community," he said. Prasad believes that Dalit leader Mayawati must stop harping on the 'I'm a Dalit's beti' line if she wants to make it any further. D Shyam Babu of Rajiv Gandhi Foundation feels that community-based politicians often get lost in the maze of identity politics. "But identity need not be diluted. This is when character comes in. Obama displayed the temperament to represent a major political party." That is the difference, feels human rights activist Anandraj Teltumbde, between the US and India as well. "A major political party has nominated him for presidency. With a similar win, Mayawati will carry the burden of the ruling class agenda as she does even now." Prasad believes that Obama's win is revolutionary because it will raise the self-esteem of the ordinary Afro-American. "That apart there will be tremendous moral pressure on India's caste order. And confidence among Dalits will certainly get a healthy fillip," he says. Babu cautions against reading too much into the US election result. "Had Obama lost, would we have said the US is full of racism?" he queries. That is Teltumbde's opinion as well. For Whites it may be atonement for the racial past but he wonders what the future holds for common blacks in the US? "Will his presidency gloss over the deep entrenched racial prejudice and damage the cause of the blacks?," he asks. That concern is palpable. Says Teltumbde, "Downtrodden people like Dalits and blacks have to understand that such victories just represent certain advances in their development. Unless their movement is alive, there is a high probability that their cause could be undermined by such personal victories."

Lawyers National Campaign against Untouchability (LANCAU Nepal) welcomes Chief Justice Kedar Prasad Giri's statement regarding access to justice for Dalit, Women and Disabled groups. Possibly, this is the first time in the history of Nepalese Judiciary; the Chief Justice expressed his serious concern over the access of Dalit people to justice. LANCAU expresses its commitment towards the judiciary in working hand in hand to attain the objectives set by the judiciary and to ensure access to justice for the traditionally marginalized communities. We would like to thank the Chief Justice for envisaging access to justice for the underprivileged group based on the discrimination they face historically, socially and due to their physical attributes.
In order to guarantee access to justice for the underprivileged, LANCAU would like to suggest the judiciary to opt for the following measures to turn its dream into reality. (1) Fee-Free Filing for the underprivileged groups: Filing of cases without any fees, which shall guarantee increased case filing from the underprivileged group, especially in criminal litigation. A waiver of associated fees can encourage the victims to exercise their right to justice without the fear of financial burden. Civil litigation also requires court fees, which is essential in terms of genuine case filing and also for associated costs. However, even civil cases can be made fee-less if the court initiated "guarantee letter" system from the underprivileged group who cannot afford. The "guarantee letter" can serve as "commitment to pay" in an event the person loses the case. The existing 'free legal aid' does not address the access to justice for the traditionally marginalized groups. (2) Prioritizing Cases: All criminal cases related to the underprivileged group should be prioritized for prompt justice. In untouchability case, if the case is not resolved under mediation and once the case makes it to the court, a prompt time line should be set for justice and a 'stay order' should be issued against the defendants to discourage them from taking any action against the plaintiff. Similar measures should be opted to ensure justice to women and disabled. (3) Coordination and Clear Direction: Clear and Open direction must be issued to Nepal Police to take up the FIR on untouchability seriously and take action against the culprit with utmost priority. Similar measures should be opted to ensure justice to women and disabled. (4) Evaluation: Tri-monthly or Semiannual evaluation of implementation of the courts decision must be done through a committee involving leading NGO, Court Official and Police. This shall guarantee efficacy of absolute justice. (5) Accessible Judiciary for the Disabled: In order to ensure access to justice for the disabled, administration and benches in the courts should have 'Disability Access doors'. Similar measure should be opted for bar association, legal aid sections and in mediation practice. (6) A uniform data-form system should be immediately initiated in case filing administration in all level of courts to determine eligibility on underprivileged grounds so that the prompt justice and prioritizing is done properly.
LANCAU also welcomes Chief Justice Giri's commitment to scrape out corruption through review of the structure of the Commission for the Investigation of Abuse of Authority and the Special Court. Likewise, we believe that adaptation of panel system per judge's specialty, setting up juvenile benches and commercial benches and drafting codes of different laws would definitely promote justice. Review and evaluation of the judiciary's strategic plan and removal of legal hurdles in procedural acts to check that court verdicts are implemented are deemed necessary. Likewise, Mediation, Arbitration and Reconciliation for settlement of disputes can prove to be effective in terms of prompt and affordable justice. Transparency of the Judicial Council and Judicial Service Commission will prove to be one more foundation stone in a true-democracy.
If the judiciary is the guarantor of justice, we as the lawyers, have the responsibility to help the judiciary attain the goal of justice. LANCAU's existing district, regional and national level mechanisms may prove to be effective to attain the aforementioned objectives.

Dalit NGO Federation has seriously drawn attention on the two incidents of caste discrimination in which two ladies in different districts of Far-western regional namely Baitadi and Doti are severely beaten by local non datis.
In the incident of Baitadi that occurred on 27 Bhadra 2064, the 18 years old Dalit girl named Manisha Nepali was severely beaten while she was bathing in the public tap by local non dalits. The reason was only that she belonged to Dalit. Surprisingly, it has come in the national daily news papers that there was direct involvement of Parliament member of Nepali Congress (Democratic) Mr. Narendra Bam in this incident. It is also mentioned that this incident was happened under his leadership. However, it is yet to be proved. The fact finding team from DNF and HRTMCC has headed toward Doti to find out the real facts.
In the another incident, the 13 years Dalit lady was also severely beaten by two local non Dalit women in Doti that occurred on 26 Bhadra 2064. The lady was beaten while she was dancing in the dancing party of her neighbor house at their invitation to celebrate Teej festival. In the Nepalese culture, there is custom to organize regular dance parties during the Teej festival. It has come in the national daily news papers that there was involvement of mother of Sopan Bohora in this incident who is the district president of Nepal Student Union affiliated to Nepali Congress.
Two Dalit women who were also invited on the occasion severely beat the Dalit girl blaming the place was unclean because of her presence as she belonged to Dalit.
Today (24 September 2007), after consulting with its member organizations, Journalists, Human Rights activists, Intellectuals and Dalit Students, DNF has jointly submitted the memorandum to different ministries drawing the attention take action against culprits provide justice, medical care and compensation to the victims immediately. The ministries include Home Ministry, Peace and Reconstruction Ministry and Agriculture Ministry respectively. The delegation team also drawn the attention separately about the incidents in fornt of honorable parliament head Mr. Subash Nembang to raise these incidents in the parliament session in front of all the parliament members to create exert pressure for taking necessary action to the real culprits.
All the Ministries have assured the delegation team that the incidents will be investigated by the government soon for taking the action against culprits and provide justice and compensation to the victim from their own. The delegation team was under the leadership Mr. Krishna Bishwokarma from DNF Mid-central Regional chapter, other members in the team were Dhana Maya Bishwokarma DNF,Mr.Tirtha Bishwokarma, DNF, Suman Poudel, DNF/SAMATA Nepal, Sushil B.K, journalist Kumal Nepali, FEDO, Tulsa Gautam, DHRO,Hari Prasad Rasaily,CUDC and Arjun Bagale, DNF/DDL Nepal respectively.
